1. Acceptance of Terms

Welcome to 360 Photography ("we," "us," or "our"). By accessing our website https://360photography.ae/, booking a photography session, or renting equipment from us, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Services & Booking

2.1. Inquiries & Consultations

All projects begin with an inquiry or consultation. A booking is not confirmed until a formal proposal has been accepted and the required deposit/retainer has been paid.

2.2. Deposits

To secure a date for photography services (Weddings, Commercial, or Virtual Tours), a non-refundable deposit (typically 50% of the total quote) is required. The remaining balance is due upon completion of the shoot or delivery of the final files, as specified in your invoice.

2.3. Rescheduling

Clients may request to reschedule a session with at least [Insert Number, e.g., 7] days' notice. Rescheduling is subject to our availability. Late rescheduling requests may incur a fee or forfeiture of the deposit.

3. Equipment Rental Policy

These terms apply specifically to clients renting camera gear, lighting, or studio equipment.

3.1. Eligibility

Renters must be at least 18 years old and provide a valid Emirates ID or Passport. We reserve the right to refuse rental to any individual at our discretion.

3.2. Security Deposit

A refundable security deposit is required for all rentals. The amount will be determined based on the value of the equipment (e.g., Fujifilm GFX100S, Sinar systems). This deposit will be returned upon the safe, timely return of the gear.

3.3. Liability for Damage & Theft

The Renter assumes full responsibility for the equipment from the time of pickup until return.

• Damage: If equipment is returned damaged, the Renter is liable for the full cost of repair.
• Total Loss: If equipment is lost, stolen, or damaged beyond repair, the Renter is liable for the full replacement cost of the item(s) at current market value.

3.4. Late Returns

Equipment must be returned by the agreed-upon time. Late returns will be charged a penalty fee equivalent to [Insert Amount, e.g., 1 full day rental rate] for every day the item is late.

4. Cancellation & Refunds

4.1. Service Cancellation

If you cancel a confirmed booking:

• More than [X] days before the shoot: The deposit remains non-refundable, but no further payment is due.
• Less than [X] days before the shoot: You may be liable for the full value of the booking.

4.2. Rental Cancellation

Rental cancellations made less than 24 hours before the pickup time may be subject to a cancellation fee.

5. Intellectual Property & Usage Rights

5.1. Photography & Video

Unless otherwise agreed in writing, 360 Photography retains the copyright to all images and 360° tours created.

• Client License: We grant the Client a non-exclusive, perpetual license to use the images for their personal or business marketing purposes.
• Restrictions: The Client may not sell or sublicense the images to third parties without our written consent.

5.2. 360° Virtual Tours

Hosting of virtual tours is subject to the platform’s terms (e.g., Matterport, CloudPano). We guarantee the delivery of the tour files/links but are not responsible for third-party hosting platform downtime.

5.3. Google Street View

For "Trusted Agency" integrations, imagery uploaded to Google Maps becomes subject to Google’s terms of service and content policies.

6. Limitation of Liability

To the fullest extent permitted by UAE law, 360 Photography shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. In the unlikely event of data loss (e.g., memory card corruption) or equipment failure preventing a shoot, our liability is limited to a full refund of any monies paid.

7. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Dubai courts.
